Terms of Service

1. Agreement
By accessing or using PathFinder AI (“the Service”), operated by Smart Path IT Ltd (“we”, “us”), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
PathFinder AI is a cloud-based incident intelligence platform that uses artificial intelligence to score, prioritise, and provide recommendations for operational incidents. The Service includes AI urgency scoring, action suggestions, trend detection, and multi-channel incident ingestion.
3. Accounts and access
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access. One account represents one organisation; sub-accounts may be created for team members.
4. Trials and pilots
Evaluation access and pilot deployments are arranged with us directly, and their scope and duration are set out in the agreement covering them. Where a pilot ends without moving to a full deployment, your data will be retained for 30 days to allow for export, after which it may be deleted.
5. Pricing and payment
Charges, billing frequency and payment terms are those set out in the agreement or order form covering your deployment. Prices are in GBP and exclude VAT where applicable.
6. Your data
You retain full ownership of all data you submit to the Service. We do not claim any intellectual property rights over your incident data. We will not access your data except as necessary to provide the Service, respond to support requests, or comply with legal obligations.
Pilot and production deployments are made in UK AWS infrastructure, with data isolated per organisation. See our Privacy Policy for full details on data handling.
7. AI-generated output
PathFinder AI provides incident scores, recommendations, and pattern analysis generated by artificial intelligence. These outputs are advisory only and should not be treated as a substitute for professional judgement. We do not guarantee the accuracy, completeness, or suitability of AI-generated recommendations. Your team is responsible for all operational decisions.
8. Acceptable use
You agree not to:
- •Use the Service for any unlawful purpose.
- •Attempt to reverse-engineer, decompile, or extract source code from the Service.
- •Resell, sublicence, or redistribute access to the Service.
- •Interfere with the operation of the Service or other users’ access.
- •Submit data containing personal information of individuals without their knowledge or consent.
9. Service availability
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control, including third-party service outages, network issues, or force majeure events.
10. Termination
Notice periods and termination rights are those set out in the agreement covering your deployment. On termination, your data will be retained for 30 days to allow for export, after which it will be deleted.
11. Limitation of liability
To the maximum extent permitted by law, Smart Path IT Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
12. Changes to terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification with 30 days’ notice. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
